The undersigned being over the age of eighteen (18), do hereby consent to my enrollment in the Brockton Police Department Citizens Police Academy. I agree to obey all instructions, orders, and commands given to me by any Police Officer, Firefighter, Employee, Instructor, or other Agent of the City of Brockton during the time of my participation in this program.
This is a legally binding Release, Waiver, Discharge and Covenant Not to Sue (collectively "Release"), entered into freely and voluntarily by me, the undersigned Releasor, on my own behalf, and on behalf of my heirs, executors, administrators, legal representatives and assigns (hereinafter collectively, "Releasor", "I" or "me"), to the City of Brockton/ Brockton Police Department.
As the undersigned Releasor, I fully recognize that there are dangers and risks I may be exposed to by participating in the activities described in the 2025 Brockton Police Department Citizens Police Academy Curriculum, incorporated herein by reference (collectively "the Activities"). As the undersigned Releasor, I understand that neither the City of Brockton nor/ the Brockton Police Department require my participation in these Activities. I acknowledge that the City of Brockton and the Brockton Police Department do not provide any kind of medical coverage for me in the event of an injury. My participation in the Activities are at my election and I acknowledge that my participation in the Activities carries with it the potential for personal injury, death and other loss.
I understand that in addition to the Activities, I will have the opportunity to accompany Brockton police officers on patrols (hereinafter "Ride-along"). During a Ride-along I will be responding to emergency calls accompanied by a supervising police officer, which can place myself and others at risk of personal injury or even death. While participating in a Ride-along, I agree to obey all instructions, orders, and commands given to me by the supervising police officer. Failure to abide by the supervising officer's instructions will be grounds for expulsion from the Citizens Academy. Participation in the Ride-along is strictly voluntarily and not a requirement for graduation from the Citizens Academy.
With informed consent, and for valuable consideration received, assume all of the risks and responsibilities in any way arising from or associated with the Activities and a Ride-along, and I release the City of Brockton and Brockton Police Department and all of their affiliates, divisions, departments and other units, committees and groups, and their respective governing boards, officers, directors, principals, trustees, legal representatives, members, owners, employees, volunteers, agents, administrators, assigns, and contractors (collectively “Releasees”), from any and all claims, demands, suits, judgments, damages, actions and liabilities of every name and nature whatsoever, whenever occurring, whether known or unknown, contingent or fixed, at law or in equity, that I may suffer at any time arising from or in connection with the Activities, including any injury or harm to me, my death, or damage to my property (collectively “Liabilities”) and I agree to defend, indemnify, and hold Releasees harmless from and against any and all Liabilities that may arise from my participation in the Activities.
As the undersigned Releasor, I recognize that this Release means I am giving up, among other things, all rights to sue Releasees for injuries, damages or losses I may incur arising from, or in connection with, my participation in the Activities and/or a Ride-along. I also understand that this Release binds my heirs, executors, administrators, legal representatives and assigns, as well as myself. I affirm that I am physically fit, have not been advised to refrain from participation in the Activities or a Ride-along by a medical professional, and have no known health-related reasons which would preclude my participation in the Activities and/or a Ride-along. I agree that this Release shall be governed for all purposes by Massachusetts law, without regard to such law on choice of law.
I ACKNOWLEDGE THAT I HAVE READ BOTH PAGES OF THIS RELEASE AND FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, HAVE SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE, AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID, THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.
